of Mounds View Staff <br />Item No: 4 <br />Meeting Date: September 3, 2013 <br />Type of Business: Work Session <br />To: Honorable Mayor and City Council <br />From: James Ericson, City Administrator <br />Item Title/Subject: Review Noise Control Regulations <br />Introduction: <br />At the August 26, 2013, City Council meeting, resident Karey Love expressed concern <br />regarding the apparent lack of noise regulations or policies that would apply to outdoor <br />concerts or events in residential districts. The cause for concern stemmed from an event <br />held by the church adjacent to the Love property. According to the event flyer, many bands <br />played from 1 pm until after 9 pm. Mr. Love complained to the police about the noise and <br />was told that nothing really could be done about it. Mr. Love encouraged the Council to <br />look at the ordinances and consider changes that would better control outdoor events such <br />as what was held by the church, in a residential district. <br />Discussion: <br />The City's noise control regulations can be found in Section 607.08: <br />607.08: NOISE CONTROL REGULATIONS: <br />Subd. 1. Loud Or Unnecessary Noises Prohibited: It shall be unlawful for any person to make or <br />cause to be made any loud, unnecessary or unusual noise which either annoys, disturbs or affects <br />the comfort, repose, health or peace of others. <br />Subd. 2. Loud Or Disturbing Noises Enumerated; Restrictions: The following acts set forth in <br />the following paragraphs are declared to be loud, disturbing and unnecessary noises in <br />violation of this Section, but said enumeration shall not be deemed to be exclusive: <br />a. Construction or Repairing of Buildings: The erection, including excavating, demolition, <br />alteration or repair of any building between the hours of ten o'clock (10:00) P.M. and seven <br />o'clock (7:00) A.M., Monday through Sunday. The City Administrator may grant authority for <br />work to occur at anytime in the event of an emergency or when it is found that such activity would <br />not affect the health, safety, comfort and repose of persons in the vicinity. <br />b. Nighttime Noise In Residential Areas; Parties: <br />(1) No person shall, between the hours of ten o'clock (10:00) P.M. and seven o'clock <br />(7:00) A.M., participate in any loud party or gathering of people from which noise emanates of a <br />sufficient volume as to disturb the peace, quiet or repose of persons residing in any residential <br />area. <br />
