<br />Item No: 2 <br />Meeting Date: January 3, 2011 <br />Type of Business: Work Session <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, City Administrator <br />Item Title/Subject: Review Section 1 of the City’s Personnel Manual <br /> <br />Introduction: <br /> <br />On December 13, 2010, the City Council adopted Resolution 7716 which approved <br />revisions to the City’s Personnel Manual. Generally, the major revisions added <br />“disclaiming” language to the introductory passages of the manual, eliminated <br />inconsistencies between Sections 1.05 and 1.37 regarding probationary employees, and <br />clarified that the City Council, not the City Administrator, approves employee terminations. <br /> Also on December 13, Staff indicated that numerous inconsequential revisions were made <br />to correct references, statutory and otherwise, position titles, footnotes and other notations. <br />References to policies which no longer exist were deleted and a few poorly written and <br />unclear passages, typographical errors, redundant paragraphs and other issues were <br />updated. Finally, Staff indicated that the offensive behavior / sexual harassment policy <br />would need to be revamped and that Kennedy & Graven has provided the necessary <br />revision. <br /> <br />Discussion: <br /> <br />At the December 13, 2010, a suggestion was made to provide the Council with copies of <br />personnel manual for discussion purposes, to ensure the policies continue to represent the <br />goals of the City Council. Because the Personnel Manual is too large to effectively review <br />and discuss in one fell swoop, Staff will present the manual in logical sections, the first <br />referencing “Workplace Issues”, labeled Exhibit 1. <br /> <br />Section 1.27 of the Personnel Manual is the policy outlining Offensive Behavior and Sexual <br />Harassment. The policy in the manual is the existing version; the policy as suggested by <br />Kennedy & Graven is attached at the end of this report, labeled Exhibit 2 <br /> <br />Recommendation: <br /> Review attached Section One of the Personnel Manual and the suggested revision to <br />Policy 1.27. Minor revisions can be made at the direction of the Council by motion, major <br />revisions such as the revision to Section 1.27 should be done by resolution.
