<br />ORDINANCE NO. 865 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE REGULATING THE POSSESSION, SALE AND CONSUMPTION OF <br />TOBACCO AND TOBACCO RELATED DEVICES AND PRODUCTS WITHIN THE <br />CITY OF MOUNDS VIEW <br /> <br />THE CITY OF MOUNDS VIEW ORDAINS: <br /> <br />Section 1. The City Council of the City of Mounds View hereby amends Title 500, Chapter <br />512 of the Mounds View City Code, regulating the sale or distribution of cigarette and <br />tobacco products within the City through the issuance of a tobacco license, by deleting the <br />Chapter in its entirety. <br /> <br />Section 2. The City Council of the City of Mounds View hereby amends Title 500 by <br />adding a new Chapter 512 of the Mounds View City Code to regulate the sale, possession <br />and use of tobacco, tobacco products, tobacco-related devices through the issuance of a <br />tobacco license, as follows: <br /> <br />CHAPTER 512 <br /> <br />CIGARETTE AND TOBACCO PRODUCTS <br /> <br />SECTION: <br /> <br />512.01: Purpose and intent <br />512.02: Definitions <br />512.03: License <br />512.04: Fees <br />512.05: Basis for denial of license <br />512.06: Prohibited sales <br />512.07: Self-service sales <br />512.08: Responsibility <br />512.09: Compliance checks and inspections <br />512.10: Other illegal acts <br />512.11: Violations and penalty <br />512.12: Suspension or revocation <br />512.13: Exceptions and defenses <br />512.14: Severability <br /> <br /> <br />512.01: PURPOSE AND INTENT: Because the City recognizes that many persons under the <br />age of 18 years purchase or otherwise obtain, possess and use tobacco, tobacco products, tobacco- <br />related devices, and nicotine or lobelia delivery devices, and the sales, possession, and use are <br />violations of both state and federal laws; and because studies, which the City hereby accepts and <br />adopts, have shown that most smokers begin smoking before they have reached the age of 18 years <br />and that those persons who reach the age of 18 years without having started smoking are significantly
