<br />Item No: 7 <br />Meeting Date: January 7, 2008 <br />Type of Business: Worksession <br />Administrator Review : ____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Interim City Administrator <br />Item Title/Subject: Review Kennedy & Graven Legal Services Retainer <br />Agreement <br /> <br />Introduction: <br /> <br />In response to a request made by the Mayor, I am providing the City Council with a copy of <br />the current legal services agreement between the City and Kennedy and Graven. If the <br />Council is inclined to terminate its relationship with Kennedy & Graven, the termination <br />clause of the agreement (Section 2.11) requires a thirty days written notice. If the Council <br />believes instead that changes are warranted with regard to the services being provided by <br />Kennedy & Graven, City Attorney Riggs would be more than willing to discuss Council <br />expectations and address any expressed concerns. <br /> <br />Discussion: <br /> <br />In 2003, at the direction of the City Council, staff distributed Requests for proposals (RFPs) <br />for municipal legal representation to firms that engage in municipal representation. Ten firms <br />responded to the RFP and six firms were interviewed. Ultimately the City Council chose to <br />remain with Kennedy & Graven and unanimously approved a two-year contract on July 28, <br />2003. The contract was renewed for one additional year on June 27, 2005 with the provision <br />that the City intended to solicit proposals for legal services at the end of the agreement term. <br />The present three-year agreement was approved by the Council by unanimous consent on <br />June 26, 2006 after having reviewed the agreement at the two previous worksessions. <br /> <br />Recommendation: <br /> <br />Please review the attached legal services retainer agreement between Kennedy & Graven <br />and the City of Mounds View. If the Council feels inclined to make a change in legal <br />representation, staff should be directed to prepare a Request for Proposals which would be <br />distributed to area firms specializing in municipal representation.
