Item No. 04 <br />Type of Business: Work Session <br />Date: March 3, 2008 <br />City Administrator Review _______ City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Desaree Crane, Assistant City Administrator <br />Item Title/Subject: Outdoor Event Policy Update <br /> <br /> <br />On February 4, 2008, Work Session, Staff and the City Council presented a draft a policy for <br />special outdoor events. (Feb 4, 2008, Work Session staff report attached) Many businesses <br />have requested to hold special outdoor events to include Moe’s and The Mermaid. Staff was <br />directed by the City Council to come up with draft policy language that would address a parking <br />plan, security plan, clean up plan, placement of portable toilet facilities, entertainment or stage <br />locations, proof of Workers Compensation Insurance, Fire Inspection, and a requirement to <br />notify residents of the event. <br /> <br />Staff was further directed at the February Work Session to have the City Attorney draft an <br />opinion on: <br /> <br />1. Whether the City would be liable for damages in the event that injuries arose as a <br />result of the City’s emergency response to a special outdoor event? <br />2. Would the City be liable for damages arising out of the fact that it issued the <br />permit for the special outdoor event? <br />3. Could the City require a bond or some other type of financial guarantee? <br /> <br />Attached is the City Attorney memorandum from the City Attorney in regard to the Special <br />Outdoor Event Permit Policy as requested for your review. <br /> <br />Staff has also gathered some additional information from other cities that have adopted Special <br />Event Policies. (attached) The City of Spring Lake Park has an Indemnification clause in their <br />ordinance that states: <br /> <br />“The permit holder must agree to defend, indemnify, and hold harmless the City, <br />its Council members, employees, officers, contractors and agents from and <br />against any and all liability. Claims, damages, costs, judgments or expenses, <br />including attorney fees, resulting directly or indirectly from any act or omission <br />arising out of, caused, by, or related to the conduct of the activities authorized by <br />the permit and such agreement will be part of the permit.” <br /> <br />The City of Edina also has an indemnification clause which is similar to the City of Spring <br />Lake Park. <br /> <br />Please review the materials provided. If the City Council would like to continue to <br />proceed with such a policy, then Staff would like to have a finalized policy before the City <br />Council on March 24, 2008.
