AMENDMENT OF JOINT POWERS AGREEMENT FOR <br /> CONSTRUCTION AND OPERATION OF FIRE TRAINING SITE <br /> WHEREAS, the parties who are signators below had entered into an agreement titled <br /> "Joint Powers Agreement - Fire Training Association", a copy of which is attached hereto; and <br /> WHEREAS, the only expenditure of funds to date pursuant to said agreement has been by <br /> the City of Fridley; and <br /> WHEREAS, a party to the agreement, the City of Columbia Heights, has given written <br /> notice to the other parties via letter dated August 10, 1992 that it no longer wishes to participate <br /> in the agreement; and <br /> WHEREAS, the remaining parties desire to amend said agreement in order to continue the <br /> project of constructing and operating a fire training site. <br /> NOW, THEREFORE, the undersigned parties agree to the following modifications of the <br /> agreement: <br /> 1. Deletion of Columbia Heights: <br /> Delete from the "Joint Powers Agreement - Fire Training Association" (copy attached, <br /> and hereafter called the AGREEMENT), the City of Columbia Heights, wherever that <br /> name appears, and change the number of"member departments" from four to three <br /> wherever stated. The undersigned hereby acknowledge receipt of a termination notice <br /> from the City of Columbia Heights by letter dated August 10, 1992 from its attorney <br /> Greggory J. Woods, and accept the termination in accordance with paragraph 16 of <br /> the AGREEMENT. There exists no claim against Columbia Heights for proportionate <br /> share-of_initial_construction_oosts_oLoperating costs. <br /> 2. Initial Construction: <br /> The "initial construction costs" identified in paragraph 6 of the AGREEMENT shall be <br /> changed to $150,000, it being understood that the parties may later increase this <br /> amount if additional contributions are approved by the parties' respective governing <br /> bodies. <br /> 3. Operating Budget: <br /> The statement in paragraph 7 of the AGREEMENT citing the 1991 Operating Budget <br /> is deleted. <br />
