Following discussion at the November 17, 1993 Planning <br />Commission meeting, the Planning Commission adopted Resolution No. 373-93 <br />at their December 1, 1993 Regular meeting. <br />That Resolution recommended that the Council place a moratorium on the <br />establishment of any new Car Lots in the City for a period of 18 months. <br />This moratorium would allow the Planning Commission and City Council time <br />to further review the subject and consider the forthcoming recommendations <br />of the Focus 2000 Issue Groups. <br />Following review of the Planning Commission's recommendation at the <br />December 6, 1993 City Council Work Session, the City Council concurred with <br />the recommendation of the Planning Commission and directed Staff to prepare <br />the appropriate Ordinance for formal consideration. Attached please find <br />Ordinance No. 533 which, if approved, would establish the moratorium. <br />Please note that the length of the moratorium is only 12 months versus the <br />18 months recommended by the Planning Commission. State law only permits <br />the adoption of an interim Ordinance for a period not to exceed one (1) <br />year. However, at the discretion of the City Council, the Moratorium may <br />be extended for an additional period of 18 months. Also, the language of <br />the Ordinance refers to both new and used car lots and, motor vehicle <br />sales. It is the opinion of the City Attorney that both references should <br />be included to ensure that all Chapters of the Municipal Code that contain <br />regulations relative to the operation of new and used car lots/motor <br />vehicle sales are addressed by the Ordinance. <br />RE_OMMENDATIOR <br />Motion to waive the reading and formally introduce Ordinance No. 533 <br />placing a Moratorium on the establishment of car lots in the City of Mounds <br />view. <br />
