7- 17 Agenda Section: 9.A <br /> CM REQUEST FOR COUNCIL CONSIDERATION Report Number 92-406C <br /> GS <br /> STAFF REPORT Report Date: 10-22-92 <br /> EA Council Action: <br /> 0 Special Order of Business <br /> CITY COUNCIL MEETING DATE October 26, 1992 0 Public Hearings <br /> 0 Consent Agenda <br /> a Council Business <br /> Item Description: Consideration of Resolution No. 4297 Regarding the Review of a Conditional <br /> Use Permit for 3030 County Road J <br /> Administrator's Review/Recommendation: <br /> - No comments to supplement this report <br /> - Comments attached. <br /> Explanation/Summary (attach supplement sheets as necessary.) <br /> SUMMARY; <br /> • <br /> On May 13, 1991, the Mounds View City Council approved resolution no. 4081 <br /> which allowed an oversized detached garage(900 sq. ft. ) and the utilization <br /> of 307 square feet of an existing attached garage as accessory building <br /> area - provided all applicable sections of the Municipal Code relating to <br /> accessory buildings were adhered to - for the property located at 3030 <br /> County Road J. <br /> Recently, in response to a request by Councilmember Rickaby, staff visited <br /> the site to determine whether conditions associated with the aforementioned <br /> request were being met. Upon inspection, it was found that an automobile <br /> was being kept in the area defined in the Conditional Use Permit as <br /> accessory building area. Chapter 40 of the Municipal Code does not allow <br /> for the storage of automobiles within accessory buildings. This is a clear <br /> violation of the Conditional Use Permit approved in Resolution No. 4081. <br /> The Mounds View Planning Commission has reviewed this Conditional Use <br /> Permit and recommended to the City Council that the Property be subject to <br /> conditions adopted as part of the original request. Their findings and <br /> recommendations are included in Resolution No. 347-92 (copy attached) . <br /> -havea-copy-of-tire-floor-pian-which -wa-s-adopted by-the-e-ity <br /> Council so you can refamiliarize yourself with the case.
