1982 - Over the owners objections, the City designated twice <br /> the amount, that Rice Creek Watershed District required, as <br /> wetland, and imposed substantial additional restrictions, <br /> including 100 foot setbacks from the wetland, virtually <br /> eliminating any possibility of development. <br /> 1986 - The owner had a short term opportunity to have clean <br /> fill brought to the site at a nominal cost of twenty cents <br /> per cubic yard (typical rates today are $5.00 per yard) . He <br /> approached the City for permission and was told by the <br /> Director of Public Works/Community Development that he (the <br /> Director) would propose it to the City and give it his total <br /> support. To the owner's misfortune, no such support for the <br /> permit was given. To the contrary, the Director did not <br /> recommend it and, instead, the owner was given a list of <br /> requirements so extensive it would have taken months to <br /> fulfill. Among them were requirements to get plan approval <br /> for and then install the storm sewer inlet that the City had <br /> wrongfully eliminated previously, a bonded development <br /> agreement, a revised wetland and flood plain map, the <br /> granting of easements to the City that the City had <br /> previously neglected to get for building Edgewood Drive and <br /> storm sewers, and a second hearing before the City Council. <br /> On top of the 12 requirements, at the last minute, the owner <br /> was informed that he would have to agree to remove the fill <br /> at any time the City might later request it. The supplier <br /> couldn't wait any longer and it turned out to be just another <br /> expensive lost opportunity for the owner. <br /> 1992 - Mounds View, without prior notice, began billing the <br /> owner at the rate of over $600 per year for lighting. The <br /> owner can only wonder why he needs to provide lighting for a <br /> wetland, what benefit this expense affords him, and what will <br /> be next. <br /> The end result is what the owner now has: no drainage, a large <br /> Designated Wetland with one hundred foot setback requirements, <br /> and_a city street over_his property_. <br /> In light of the unusual and ever-changing control the City has <br /> exercised over this property, it seems necessary to meet with the <br /> City Council to discuss its future and mutually decide what to do <br /> with it. <br /> Would you please set up a meeting up for us and contact me at <br /> your earliest convenience.
