Consequently, in accordance with the Charter: <br /> <br />“ . . . the Council shall not make such improvement at the expense of <br />the property benefited, unless, in the meantime, there be filed with the <br />Council a petition asking that the improvement be made, signed by <br />property owners proposed to be assessed for such improvement at least <br />equal in number to those who signed the petition against the <br />improvement; in which event the Council may disregard the petition <br />against the improvement.” <br /> <br /> <br />Also, per subdivision 4 of Section 8.04 of the City Charter, “When a proposed <br />improvement is disallowed under the foregoing subdivisions, the Council shall not vote on <br />the same improvement within a period of one year after the public hearing on said <br />improvement. “ <br /> <br />The Council has several options for moving forward, but if the petition is found to be <br />sufficient, construction will not occur in 2007. The Council will need to meet in work session <br />to discuss options for moving forward. <br /> <br />Recommendation: <br />It is recommended that the City Council adopt the attached Resolution 7018 approving <br />the sufficiency of petition in opposition to the 2007-08 Street Improvement Project, <br />ending project consideration as proposed.
