Mounds View City Council October 9, 2006 <br />Regular Meeting Page 7 <br /> <br />Director Ericson explained the process for the ordinance and said no action would take place at 1 <br />present. He said the intent is not to cause any confusion or consternation among the residents. 2 <br />He stated the City wants to ensure that awareness is raised about wetlands and the purpose the 3 <br />regulations serve. 4 <br /> 5 <br />Mayor Marty opened the public hearing at 7:41 p.m. 6 <br /> 7 <br />Bob King, 7408 Silver Lake Road, asked if there are street addresses on the map. Director 8 <br />Ericson stated there were not. Mr. King stated his concern is the houses in the wetland area. He 9 <br />said street addresses are key to the maps. He also asked if there is a dispute about the wetland 10 <br />boundary, how it will be handled. 11 <br /> 12 <br />Director Ericson replied that the map in front of the Council presently does not have addresses, 13 <br />but the maps can easily include addresses. He stated it would be a good idea for the City if SEH 14 <br />could physically verify what is on the maps if there are boundary questions from the residents. 15 <br />He stated he would like to ensure the maps are as accurate as possible. Director Ericson stated 16 <br />that if there are enough questions, the second reading could be deferred to ensure that such areas 17 <br />are cleared up. 18 <br /> 19 <br />Mr. King stated that without knowing where his property is located on the map it is difficult to 20 <br />determine where the wetland buffer falls. 21 <br /> 22 <br />Mayor Marty stated that the wetland and buffer zones have shrunk on a significant portion of 23 <br />properties affected by wetlands and wetland buffers. 24 <br /> 25 <br />Mayor Marty asked about the cost of having the engineers physically survey the areas. Director 26 <br />Ericson replied that depending on time, it could be between $50-75. He stated the cost should be 27 <br />the City’s responsibility. Director Ericson encouraged Mr. King and others with questions to call 28 <br />him at City Hall. 29 <br /> 30 <br />Mark Schnor, 2949 County Highway 10, stated that an area marked a wetland at Spring Lake 31 <br />Road and County Road 10 is a drainage ditch holding pond. He stated there was a wetland 32 <br />behind the property and the drainage ditch was put in front due to site constraints. He stated the 33 <br />question is if a drainage ditch or pond should be considered a wetland. 34 <br /> 35 <br />Mr. Schnor explained that his home is within the 100-foot buffer of the drainage ditch. He said 36 <br />his problem is with his home being so close, and being on PUD ground, whether he could 37 <br />develop his land. He asked if the property value is affected by the designation of the holding 38 <br />pond as a wetland. 39 <br /> 40 <br />Director Ericson stated the area was not previously wetland and was created as part of the 41 <br />adjoining development. He stated the area is considered a wetland by the Rice Creek Watershed 42 <br />District and asked if the City would like to consider it a wetland as well. He stated his concern is 43 <br />also whether or not to consider drainage ditches and pond wetlands. He stated the designation 44 <br />does not prohibit development, but means it is subject to a review process. 45
