<br /> <br />RESOLUTION NO. 7029 <br /> <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> <br />A RESOLUTION APPROVING A WETLAND ALTERATION PERMIT <br />TO CONDUCT TREE REMOVAL ACTIVITY ON LOT 4, BLOCK 1, MUELLER <br />ADDITION, REQUESTED BY EICHI, INC.; <br />PLANNING CASE NO. WA07-001. <br /> <br />WHEREAS, Martin Harstad, representing the owner EICHI, Inc., has requested a <br />wetland alteration permit to allow for the removal of trees from property legally described as <br />Lot 4, Block 1, Mueller Addition, commonly referred to as the “Longview Estates” parcel; <br />and, <br /> <br />WHEREAS, the Longview Estates tract of land is located within a wetland zoning <br />district and is subject to the provisions and regulations articulated in Chapter 1010 of the <br />Mounds View Municipal Code; and, <br /> <br />WHEREAS, tree removal activity is defined as “development” under Section 1010.05 <br />of the Code and development within such districts is allowed by permit only; and, <br /> <br />WHEREAS, the City Council has found that wetlands within the City, as part of the <br />ecosystem, are critical to the present and future health, safety and general welfare of the <br />land, animals and people within the City, as well as within the Rice Creek Watershed <br />District; and, <br /> <br />WHEREAS, the City Council has in mind its statutory obligation to comply with <br />Chapters 104, 105 and 112 of Minnesota State Law, the regulations of Rice Creek <br />Watershed District, Regulations of the Department of Natural Resources, including <br />provisions for protected waters, Public Law 92.500 (Federal Water Pollution Control Act), <br />open space policies of the Metropolitan Council and its guidelines encouraging protection <br />and enhancement of marshes, wetlands in the flood plain area and the public interest in <br />preventing irreparable destruction or deterioration of valuable natural resources; and, <br /> <br />WHEREAS, the City Council has reviewed the following documents regarding this <br />proposal: <br /> <br />a.
