Item No. 07A <br />Type of Business: PH & CB <br />Meeting Date: March 12, 2007 <br />City Administrator Review: ______ City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Desaree Crane, Administrative Assistant <br />Item Title/Subject: Public Hearing to Consider Resolution 7021, a <br />Resolution Approving a Transfer of Ownership for an <br />On-Sale Intoxicating Liquor License from Moundsvista, <br />Inc. (d.b.a. The Mermaid) to Mounds View Bowling, Inc., <br />(d.b.a. Mermaid Lanes) located at 2200 County Highway <br />10 <br /> <br />Section 502.08 of the City Code requires that a public hearing be held prior to any intoxicating <br />liquor license. The City of Mounds View issued an on-sale intoxicating liquor license for The <br />Mermaid on June 30, 2006. The Mermaid will change ownership from Dan Hall (Moundsvista, <br />Inc.) to a Michael and Matthew Anderson (Mounds View Bowling, Inc.) on or about April 12, <br />2007. <br /> <br />Mounds View Bowling, Inc., has submitted the city liquor license application materials (to <br />include the application to stay open until 2am per Ordinance 717), and the applicable fees. The <br />notice of this public hearing was sent out to residences within a 350 feet radius, and the Notice <br />of Public Hearing was published in the Mounds View/New Brighton Bulletin. The following <br />investigations and inspections have been conducted to determine whether there is cause for the <br />City to deny any of the above referenced intoxicating liquor license application: <br /> <br />Police Inquiry and Investigations <br />The report has not come back from the Minnesota Department of Criminal Apprehension for <br />Michael and Matthew Anderson. The Intoxicating liquor license will be pending a satisfactory <br />report from this agency. . <br /> <br />Utility Billing Inquiry (City of Mounds View) <br />The Mermaid does owe the City of Mounds View $1,533.74. This transfer of liquor license will <br />not be processed unless this payment is made in full. <br /> <br />Fire Inspection (City of Mounds View Fire Marshal) <br />The City’s Fire Marshal has inspected the location currently called The Mermaid and issued a <br />satisfactory report. However, the establishment will be re-inspected when the transferring of <br />building ownership is finalized in April. <br /> <br />Recommendation <br /> <br />Staff recommends opening the Public Hearing for Public Comment. In addition, Staff approves <br />the transfer of ownership from Dan Hall (Moundsvista, Inc.) to a Michael and Matthew Anderson <br />(Mounds View Bowling, Inc.) pending the payment of the utility bill and a satisfactory report from <br />the Minnesota Department of Criminal Apprehension.
