<br />Item No: 8G/8H <br />Meeting Date: March 26, 2007 <br />Type of Business: Consent <br />Administrator Review: ____ <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br />From: Heidi Heller, Planning Associate <br />Item Title/Subject: Schedule Public Hearings for Monday, March 9, 2007 at <br />7:15 PM and 7:20 PM to Consider Minor Subdivision <br />and Conditional Use Permit Requests Associated with <br />the property Located at 2280 County Road I, “The <br />Station”, and to Consider Zoning Code Amendments to <br />Chapters 1102 and 1113. <br /> <br /> <br />Background: <br /> <br />This report is prepared simply to provide background information regarding the requested <br />setting of public hearings to consider the requests submitted by the owners of “The Station” <br />located at 2280 County Road I and proposed zoning code amendments. <br /> <br />Discussion: <br /> <br />Four planning requests were submitted by Leon Theis and Tom Manke, owners of “The <br />Station” in order to bring the gas station into conformance with the City Code: a minor <br />subdivision for a lot split and creation of new lots at 2280 and 2284 County Road I, rezoning <br />the property from B-2 Limited Business, to B-3 Highway Business, a Conditional Use Permit <br />in order to allow a gas station in a B-3 district, and a Comprehensive Plan Amendment to <br />change the land use designation from Neighborhood Commercial (NC) to Highway <br />Commercial (HC). <br /> <br />The Station was built in 1959 as “Gulf” and currently exists as a legal nonconforming use. <br />The property owners would like to add two additional fuel pumps to the site and expand the <br />current canopy to cover both sets of pumps. By doing this, the nonconforming use would be <br />expanded. The City Code allows the existing nonconformance to continue, but not be <br />expanded upon. This application involves planning requests, which if approved, would bring <br />the gas station into total code compliance and allow them to move forward with the addition <br />of more fuel pumps. <br /> <br />After discussion at the March 7th Planning Commission meeting, Staff has been working on a <br />solution to allow The Station at 2280 County Road I, to become a conforming use without <br />rezoning their property or doing a comprehensive plan amendment. The Planning <br />Commission indicated that they were supportive of The Station’s desire to become <br />conforming and add two additional fuel pumps, but were hesitant to change the property to a <br />higher intensity designation because of what that could be opening this site up to in the future <br />if the owners were to sell the property. <br /> <br /> <br /> <br />
