Staff Report <br />Resolution 7061 <br />Page 2 of 2 <br /> <br />pattern of slow compliance with code requirements and after repeated follow up <br />inspections the conditions outside 5440 Jackson Dr continue to violation Nuisance Code <br />Requirements. This continues despite the issuance of three court citations and more <br />than 20 code violation cases opened. Rather than summarize years of code compliance <br />activity in a brief report, staff has attached copies of various correspondence and code <br />compliance notices over the past 13 years for Council review. <br /> <br /> <br />Discussion: <br /> <br />Section 607.09 Subdivision 5 of the Nuisance Code provides the City the opportunity to reach <br />compliance by abating (correcting) items in violation of the requirements contained within <br />Chapter 607. In non emergency cases where no immediate threat to the public health and <br />safety exists the City code requires that staff obtain City Council authorization prior to <br />abatement of violations and notify the property owner of their opportunity to be heard before <br />the council, provided however, that at least 10 days notice is provided. Staff has satisfied these <br />and other applicable requirements of Chapter 607 of the City Code. Mr. Courtney was notified <br />in writing of staff’s intent to seek City Council authorization to abate conditions. <br /> <br /> <br />Recommendations: <br />Staff recommends consideration and approval of Resolution 7061 authorizing abatement <br />of nuisance code violations at 5440 Jackson Drive.
