MVFPZ.ORD 3/18/92 <br /> CHAPTER 49 <br /> FLOOD PLAIN ZONING ORDINANCE <br /> 49. 01. STATUTORY AUTHORIZATION, FINDINGS OF FACT AND PURPOSE. <br /> Subdivision 1. Statutory Authorization. The Legislature of <br /> the State of Minnesota has, in Minnesota Statutes, Chapter 104, and <br /> in the Mounds View Municipal Code, Chapter 40, delegated the <br /> responsibility to local governmental units to adopt regulations <br /> designed to minimize flood losses. Therefore, the City Council of <br /> Mounds View, Minnesota, does ordain as follows: <br /> Subdivision 2 . Findings of Fact. <br /> (a) The flood hazard areas of Mounds View, Minnesota, ale <br /> subject to periodic inundation which results in potenti$l <br /> loss of life, loss of property, health and safety <br /> hazards, disruption of commerce and governmental <br /> services, extraordinary public expenditures for flood <br /> protection and relief, and impairment of the tax base, <br /> all of which adversely affect the public health, safety, <br /> and general welfare. <br /> (b) Methods Used to Analyze Flood Hazards. This Ordinapce is <br /> based upon a reasonable method of analyzing flood 'hazards <br /> which is consistent with the standards established by the <br /> Minnesota Department of Natural Resources. <br /> Subdivision 3 . Statement of Purpose. It is the purpose of <br /> this Ordinance to promote the public health, safety, and general <br /> welfare and to minimize those losses described in Subdivision 2 , <br /> Section (a) , by provisions contained herein. <br /> 49. 02 . GENERAL PROVISIONS. <br /> Subdivision 1. Lands to Which Chapter Applies. This Chapter <br /> shall apply to all lands within the jurisdiction of Mounds View <br /> shown on the Flood Plan Zoning Map as being located within the 100- <br /> year flood boundary. These lands are delineated as flood insurance <br /> zones A-1, A--2 , A-3, A-4, A-6, A-7 or A-H. <br /> Subdivision 2 . Establishment of Flood Plain Zoning Map. The <br /> Flood Plain Zoning Map together with all materials attached thereto <br /> is hereby adopted by reference and declared to be a part of this <br /> ordinance. The attached material shall include the Flood Insurance <br /> Study for the City of Mounds View prepared by the Federal Insurance <br /> Administration dated March 3 , 1983 , and the Flood Boundary and <br /> Flood-way Maps and Flood Insur-ance RateMapstherein-.- The Official <br /> Zoning Map shall be on file in the office of the Clerk- <br /> Administrator. <br /> Subdivision 3 . Regulatory Flood Protection Elevation. The <br /> Regulatory Flood Protection Elevation shall be an elevation no <br /> lower than one foot above the elevation of the regional flood. <br /> 49 - 1 <br />
