Item No. 07A Type of Business: PH & CB Meeting Date: May 14, 2007 City Administrator Review: ______ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Desaree Crane, Assistant to the City Administrator Item Title/Subject: Public Hearing to Consider Resolution 7068, a Resolution Approving an On-Sale Intoxicating Liquor License for Totino’s Italian Kitchen located at 2535 County Highway 10 Section 502.08 of the City Code requires that a public hearing be held prior to any intoxicating liquor license. Totino’s Italian Kitchen is considering opening a restaurant located at 2535 County Highway 10. Before going any further with acquiring this property, Totino’s would like to be considered for an On-Sale Intoxicating Liquor License to ensure they can get the proper licensing before going further in their negotiation process. Totino’s Italian Kitchen has submitted the city liquor license application materials (to include an outdoor liquor endorsement), and the applicable fees. The notice of this public hearing was sent out to residences within a 350 feet radius, and the Notice of Public Hearing was published in the Mounds View/New Brighton Bulletin. The following investigations and inspections have been conducted to determine whether there is cause for the City to deny any of the above referenced intoxicating liquor license application: Police Inquiry and Investigations The report has not come back from the Minnesota Department of Criminal Apprehension for the applicant. The Intoxicating liquor license will be pending a satisfactory report from this agency. . Utility Billing Inquiry (City of Mounds View) No Issues. Fire Inspection (City of Mounds View Fire Marshal) The City’s Fire Marshal will inspect the property when Totino’s acquires the property. Totino’s will be submitting plans and permit applications to the Community Development Department in order to configure the property into a restaurant. Totino’s is considering building a deck on the property in order to sell food and liquor outside. Recommendation Staff recommends opening the Public Hearing for public comment. In addition, Staff approves Totino’s Italian Kitchen On-Sale Intoxicating Liquor License pending a satisfactory report from the Minnesota Department of Criminal Apprehension and a passing fire inspection. This liquor license, including Outdoor Endorsement, will be effective on July 1, 2007 and expire on June 30, 2008. Respectfully Submitted Desaree M. Crane
