V <br /> Agenda Section: 9.9 <br /> OM��D� REQUEST FOR COUNCIL CONSIDERATION Report Number: 92-234C <br /> Report Date: 4-9-9 2 <br /> fr <br /> C STAFF REPORT Council Action: <br /> ❑ Special Order of Business <br /> CITY COUNCIL MEETING DATE April 13, 1992 ❑ Public Hearings <br /> ❑ Consent Agenda <br /> C Council Business <br /> Item Description: Resolution No. 4217 Request for Variance, 2673 Sherwood, MacMay Homes <br /> Administrator's Review/Recommendation: <br /> - No comments to supplement this report <br /> - Comments attached. <br /> Explanation/Summary (attach supplement sheets as necessary.) <br /> SUMMARY; <br /> MacMay Homes, Inc. has requested a variance to allow the construction of <br /> a single family home at 2673 Sherwood Road, legally known as Lot 16, <br /> Block 1, Red Oak Park, with a side yard setback of five(5) feet where a <br /> ten(10) foot setback is required by Municipal Code and, a front yard <br /> setback of 30.5 feet where a setback of 58 feet is required by a <br /> previous planning action. <br /> Chapter 40. 05 Subdivision C requires that a ten (10) foot setback be <br /> maintained for structures located on Residential property except that <br /> garages may be located at a five(5) foot setback. <br /> In the Fall of 1986, approval was given for what is currently Red Oak <br /> Park. At the time of approval for that plat, stipulations covering <br /> setback requirements for certain lots within the subdivision were <br /> included in City Council Resolution No. 2120. Specifically, Lot 16 was <br /> to have a front yard setback of 58 feet. This stipulation was intended <br /> to keep a principal structure located on the property in line with <br /> three(3) homes to the immediate East of the subject property which all <br /> had front yard setbacks of approximately 58 feet. <br /> In addi-tion to the—a—ormeent-i-oned front yard set-back—requirement-,—a 25 <br /> foot drainage easement is located along the Eastern property line. This <br /> easement, along with the required building setback on the West property <br /> line, severely limit the width of the buildable area on the lot. As a <br /> result of these limitations, the location of a home on the property with <br /> an orientation towards Sherwood Road becomes somewhat difficult. <br /> The Mounds View Planning Commission, at their April 1, 1992 meeting, <br /> denied the variance as requested. As allowed in Chapter 40.26 <br /> Subdivision E, the applicant has appealed that decision to the City <br /> Council.
