V
Agenda Section: 9.9
OMD REQUEST FOR COUNCIL CONSIDERATION Report Number: 92-234C
Report Date: 4-9-9 2
fr
C STAFF REPORT Council Action:
❑ Special Order of Business
CITY COUNCIL MEETING DATE April 13, 1992 ❑ Public Hearings
❑ Consent Agenda
C Council Business
Item Description: Resolution No. 4217 Request for Variance, 2673 Sherwood, MacMay Homes
Administrator's Review/Recommendation:
- No comments to supplement this report
- Comments attached.
Explanation/Summary (attach supplement sheets as necessary.)
SUMMARY;
MacMay Homes, Inc. has requested a variance to allow the construction of
a single family home at 2673 Sherwood Road, legally known as Lot 16,
Block 1, Red Oak Park, with a side yard setback of five(5) feet where a
ten(10) foot setback is required by Municipal Code and, a front yard
setback of 30.5 feet where a setback of 58 feet is required by a
previous planning action.
Chapter 40. 05 Subdivision C requires that a ten (10) foot setback be
maintained for structures located on Residential property except that
garages may be located at a five(5) foot setback.
In the Fall of 1986, approval was given for what is currently Red Oak
Park. At the time of approval for that plat, stipulations covering
setback requirements for certain lots within the subdivision were
included in City Council Resolution No. 2120. Specifically, Lot 16 was
to have a front yard setback of 58 feet. This stipulation was intended
to keep a principal structure located on the property in line with
three(3) homes to the immediate East of the subject property which all
had front yard setbacks of approximately 58 feet.
In addi-tion to the—a—ormeent-i-oned front yard set-back—requirement-,—a 25
foot drainage easement is located along the Eastern property line. This
easement, along with the required building setback on the West property
line, severely limit the width of the buildable area on the lot. As a
result of these limitations, the location of a home on the property with
an orientation towards Sherwood Road becomes somewhat difficult.
The Mounds View Planning Commission, at their April 1, 1992 meeting,
denied the variance as requested. As allowed in Chapter 40.26
Subdivision E, the applicant has appealed that decision to the City
Council. I have included City Council Resolution No. 4217, which can
either approve or deny the request, for your consideration.
(//:----
RECOMMENDATION; Paul Harrington, City lanner
Adopt City Council Resolution No. 4217 either approving or denying the
request for variance of MacMay Homes, Inc. , 2673 Sherwood Road.
