<br />Item No: 7G <br />Meeting Date: May 29, 2007 <br />Type of Business: CB <br />Administrator Review: ____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Second Reading and Adoption of Ordinance 792, an <br />Ordinance Amending Chapter 1202 (Subdivision Plats <br />and Procedures) of the Mounds View Municipal Code <br />Introduction: <br /> <br />As part of our ongoing effort to ensure the City’s Municipal Code is up to date and <br />consistent with City goals, policies and procedures, staff reviewed the City’s Subdivision <br />Code (Title 1200) and, in consultation with the City Attorney, is suggesting amendments <br />to clarify and improve the effectiveness of the subdivision requirements. <br /> <br />Discussion: <br /> <br />The City’s subdivision regulations are straightforward with quantifiable requirements and <br />reasonable standards for approval. The regulations, however, treat all development and <br />land divisions the same when in reality most divisions have unique characteristics. The <br />City Attorney has proposed language that provides reasonable authority to condition <br />subdivision approval on “compliance with all requirements deemed necessary to preserve <br />neighborhood aesthetics or to protect the health, safety and welfare of neighboring <br />landowners and the future residents within the subdivision.” Staff concurs with the <br />suggested language. <br /> <br />The City Council approved the first reading of Ordinance 792 on May 14, 2007. <br /> <br />Recommendation: <br /> <br />Staff and the City Attorney recommends holding the second reading and approving <br />Ordinance 792, an Ordinance which amends Chapter 1202 of the Municipal Code to allow <br />the City to condition plat approval on compliance with all requirements deemed necessary <br />to preserve neighborhood aesthetics or to protect the health, safety and welfare of <br />neighboring landowners and the future residents within the subdivision.
