<br /> <br /> <br />ORDINANCE 794 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE AMENDING THE MUNICIPAL CODE OF MOUNDS VIEW BY <br />AMENDING CHAPTER 1009 ENTITLED “SWIMMING POOLS” <br /> <br />The Council of the City of Mounds View does hereby ordain: <br /> <br />SECTION 1: Chapter 1009, Section 1009.03, “Location of Pool”, is hereby amended with the <br />proposed additions underlined and the deletions stricken as follows: <br /> <br />1009.03: LOCATION OF POOL: <br /> <br />Subd. 1. Compliance with Zoning Provisions; Nuisance Prohibited: Any outdoor swimming <br />pool, its fencing or barriers, its pumps, filters, heating units or any other noise-making <br />mechanical equipment, as well as the use of said pool, shall be solely located in the <br />backyard of on an authorized premises not less than ten feet from any property <br />line and not less than three feet from any other building or structure. Pools and <br />associated mechanical equipment shall be maintained so as not to constitute an <br />unattractive, public or private nuisance1. Swimming pools shall be located on property <br />in a manner so as to comply with all applicable provisions of Title 1100 of this Code. <br />(1988 Code §59.07) <br /> <br />Subd. 2. Utility Easements: Pools shall not be located within any utility easement or be <br />over or under any utility lines. (1988 Code §59.08) <br /> <br /> 1 See Chapter 604 607 of this Code for Nuisance provisions. <br /> <br /> <br />SECTION 2: Chapter 1009, Section 1009.04, “Fencing Required”, is hereby amended with <br />the proposed additions underlined and the deletions stricken as follows: <br /> <br />1009.04: FENCING REQUIRED: <br /> <br />Subd. 1. All outdoor swimming pools shall be made inaccessible when not in use by <br />a nonclimbable type of fence, wall or barrier. All openings or points of entry <br />into the pool area enclosure shall be equipped with locking gates. The fence <br />and gates shall be at least four (4) feet in height and shall be constructed of a <br />material approved by the building official. All fence posts shall be decay <br />resistant or corrosion resistant and shall be set in concrete bases or other <br />suitable protection. The opening between the bottom of the fence and the <br />ground or other surface shall not be more than two (2) inches. <br />
