Mounds View City Council July 23, 2007 <br />Regular Meeting Page 2 <br /> <br />Administrator Ulrich explained that the City Attorney feels that the Chapter 12 amendment 1 <br />should be published for public hearing ,as it was not originally published. 2 <br /> 3 <br />Council Member Mueller noted that the Charter states that the Clerk Administrator determines 4 <br />sufficiency of a petition. And, she is a little bit concerned with not seeing a definition of a 5 <br />frivolous petition, because that allows the Council to throw a petition out without having true 6 <br />cause to determine it frivolous. 7 <br /> 8 <br />Mr. Thomas, Chair of the Charter Commission, addressed the Council and explained the purpose 9 <br />behind how the document was drafted. 10 <br /> 11 <br />City Attorney Riggs suggested defining the criteria used to determine that a petition is frivolous. 12 <br /> 13 <br />Mr. Thomas commented that the changes to Chapter 12 were necessary due to changes to 14 <br />Chapters 3 and 5 for consistency. 15 <br /> 16 <br />MOTION/SECOND: Marty/Mueller. To Approve Ordinance 790, an Ordinance Amending 17 <br />Chapters 3 and 5 of the Mounds View City Charter. 18 <br /> 19 <br />Council Member Stigney said that this addresses his major issue with frivolous petitions and, 20 <br />there are several other things, but none of them serious enough to force this to a referendum. 21 <br /> 22 <br />ROLL CALL: Marty/Stigney/Flaherty/Hull/Mueller 23 <br /> 24 <br /> Ayes – 5 Nays – 0 Motion carried. 25 <br /> 26 <br /> B. Resolution 7108 Adopting the Global Release and Settlement Agreement, 27 <br /> including Approval of Various Leases 28 <br /> 29 <br />City Attorney Riggs explained that this is a continuation of the EDA’s discussion held earlier this 30 <br />evening. 31 <br /> 32 <br />City Attorney Riggs reviewed Resolution 7108 that goes along with a Resolution for the EDA to 33 <br />approve with releases to finalize the Relocation Agreement and the Amended and Restated 34 <br />Development Agreement. 35 <br /> 36 <br />City Attorney Riggs read language to be inserted defining the global release and settlement. 37 <br /> 38 <br />MOTION/SECOND: Flaherty/Mueller. To Approve Resolution 7108, Adopting the Global 39 <br />Release and Settlement Agreement. 40 <br /> 41 <br />Council Member Stigney indicated that he would like to see the wording used that the City will 42 <br />receive any and all rents. 43 <br /> 44 <br />Council agreed. 45
