(2) Fifty thousand dollars ($50,000.00) for loss of means of support of any one (1) <br />person in any one (1) occurrence and, subject to the limit for one (1) person, one hundred <br />thousand dollars ($100,000.00) for loss of means of support of two (2) or more persons in <br />any one (1) occurrence. <br /> <br /> b. Bond: A bond of a surety company with minimum coverages as provided in <br />subdivision la hereof. <br /> <br /> c. Securities: A certificate of the State Treasurer that the licensee has deposited with the <br />State Treasurer one hundred thousand dollars ($100,000.00) in cash or securities which <br />may legally be purchased by savings banks or for trust funds having a market value of <br />one hundred thousand dollars ($100,000.00). <br /> <br /> d. Approval by Council: The proof of financial responsibility under this subdivision shall <br />be approved by the Council and, when required, by the Commissioner of Public Safety. <br />The Municipal Attorney shall approve the form of the financial responsibility. <br /> <br />Subd. 2. Revocation of License: The operation of such off-sale or on-sale liquor business <br />without having on file, at all times, with the Municipality proof of financial responsibility <br />shall be grounds for immediate revocation of the license. Notice of cancellation of a <br />current liquor liability policy shall service as notice of the impending revocation of the <br />license. (1988 Code §100.03) <br /> <br /> <br />If their liquor liability lapses effective August 27, 2007, then according to City Code 507.02, subd 2., <br />this is grounds for immediate revocation of the license. <br /> <br />The law firm representing the owner of Robert’s Sports Bar and Entertainment, did send a letter of <br />formal response to the City. In this letter, it states that any action to revoke Robert’s Sports Bar and <br />Entertainment’s liquor license before November 12th, only “interferes with and damages his ability to <br />sell the business for market value.” The Mounds View City Attorney disagrees and attached is his <br />response. <br /> <br />The Mounds View City Attorney recommends that the liquor license for Robert’s Sports Bar and <br />Entertainment be suspended rather than revoked. According to the attached response from the City <br />Attorney, this would allow Robert’s to return to operation as a licensed entity as soon as possible <br />should the property comply with all licensed requirements. If the City Council were to revoke their <br />license, then Robert’s Sports Bar and Entertainment would have to re-submit their liquor license and <br />pay all applicable fees as if there were a new business coming into Mounds View. <br /> <br /> <br />Recommendation: <br /> <br />Staff recommends suspending the On-Sale Intoxicating Liquor License until Robert’s Sports Bar <br />complies with the licensing requirements. <br />Respectfully submitted, <br />Desaree Crane <br /> <br /> <br /> <br /> <br /> <br /> <br />
