Mounds View City Council August 13, 2007
Regular Meeting Page 21

1
Council Member Mueller said that there is a schedule of events for the Festival in the Park on the 2
City’s website. She then reviewed the schedule of events for Council. 3
4
Council Member Mueller thanked Medtronic for providing the fireworks for the Festival. 5
6
B. Reports of Staff 7
8
Community Development Director Ericson explained that there has been a City wide ban on 9
recreational fires adopted due to the drought conditions. Staff will notify residents in all manners 10
available including posting at City Hall, reader board, cable channel, and the website. 11
12
Community Development Director Ericson explained that there are some things to discuss 13
regarding the liquor license facilities. Director Ericson explained that Moes is not complying 14
with the Resolution approving its liquor license due to failure to replace a kitchen hood, as 15
approval was contingent upon satisfactory review by the Fire Marshall. There is a substantial 16
cost in replacing this hood. However, the owner of Moe’s has not provided an estimated date for 17
replacement. Staff recommends red tagging the kitchen hood, as that would cause an impact, but 18
not as large of an impact as would revoking the liquor license. 19
20
Mayor Marty suggested directing them to replace it before the next City Council meeting or the 21
Council would consider revoking the liquor license. 22
23
Council Member Flaherty asked whether the City has any funds to loan to assist the business 24
owner with getting this hood replaced. 25
26
Staff will look into what options may be available. 27
28
Council Member Stigney asked what determines a delinquency with taxes, and noted that the 29
Mermaid does not have delinquent taxes listed, but they have only made a partial payment. 30
31
Finance Director Beer indicated that the County taxes are considered current year taxes, and they 32
assess a fee and interest, but they are not considered delinquent by the County until the year goes 33
by. 34
35
Community Development Director Ericson explained that the Mermaid has not fully paid the 36
first half taxes for this year. But, with Roberts, that goes back three years, and Staff is looking 37
for direction from Council as to how to proceed with the liquor license revocation. 38
39
Council Member Mueller indicated that Council was assured that compliance checks were 40
finalized when the approval was before Council. 41
42
Community Development Director Ericson explained that Staff sent out a letter to the 43
Department of Revenue and did not get any response, so Staff has changed the procedure to 44
require checking online and with the County. 45
