<br />Item No: 8G <br />Meeting Date: September 24, 2007 <br />Type of Business: Consent <br />Administrator Review: ____ <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Authorizing the Execution of an Amended and Restated <br />Easement Agreement Between the City of Mounds View <br />and Medtronic, Inc. <br /> <br />Introduction: <br /> <br />At the September 10, 2007 City Council meeting, City Administrator Kurt Ulrich forwarded a <br />request to the Council from Medtronic relating to their use of the holding pond on City-owned <br />property adjacent to their Mounds View Medtronic CRDM facility. <br /> <br />Discussion: <br /> <br />Medtronic expressed a desire to install an aerator and fountain apparatus within the pond to <br />promote water clarity and circulation for aesthetic purposes. (Refer to the letter from Jim <br />Driessen.) The City Council expressed support of the proposal so long as it was explicitly <br />understood that the City was not liable for the maintenance of the aerator. The City Attorney <br />prepared an Amended and Restated Easement Agreement (attached) addressing costs, <br />liability and maintenance. <br /> <br />Recommendation: <br /> <br />Approve Resolution 7160 Authorizing the Execution of the Amended and Restated Easement <br />Agreement Between the City of Mounds View and Medtronic, Inc. to permit the installation <br />and operation of a pond aerator and water fountain. <br /> <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />Interim City Clerk / Administrator <br /> <br />
