Mermaid Sign Request
April 2, 2007
Page 2

Recommendation:

Direction is requested from the City Council in response to the request from Mr. Hall. If the
Council believes the sign can be replaced despite the moratorium, it will need to direct staff to
prepare a resolution which finds that either extenuating circumstances warrant approval or
that the sign replacement would fall outside the provisions of the moratorium. The resolution
would be brought back for Council action on April 9, 2007. If the Council chooses this option,
a condition prohibiting off-site advertising would be incorporated into the resolution.

If the City Council does not support the replacement of the Mermaid sign using newer LED
technology, a resolution indicating as much would be prepared for the Council’s
consideration on April 9, 2007. Such a resolution will address the fact that a moratorium is in
place and that the City has not completed its study on the issue of electronic signs and the
safety considerations associated with them.

Respectfully submitted,

________________________
James Ericson
Community Development Director
