<br /> <br />March 17, 2005: Regarding the condition of the building, after no further progress had <br />been made, I sent another letter to Mr. Bteibet reiterating the need <br />to make immediate improvements to the property. <br /> <br />April 4, 2004: Mounds View Fire Marshal Osmonson sent a letter to Mr. Bteibet <br />regarding the outstanding fire code violations. <br /> <br />April 8, 2005: Spoke with Mr. Bteibet about the need to maintain his property and <br />repair the partially demolished mansard roof extension. Failure to <br />comply would result in citations being issued. Mr. Bteibet <br />acknowledged his responsibilities. <br /> <br />May 16, 2005: Sent letter to subject after observing that advertising signs had been <br />erected on the retail and car wash buildings. Roof mounted signs <br />are prohibited in the City, and had Mr. Bteibet obtained a permit for <br />the work, staff could have informed him of this prior to their <br />installation. Requested subject obtain a permit and install the signs <br />in compliance with City Code. Mr. Bteibet did not respond to this <br />letter <br /> <br />July 7, 2005: Sent letter informing subject that his business license was in <br />jeopardy for failing to correct the fire code violations. <br /> <br />July 11, 2005: Sent letter addressing the sign code violations, continued <br />degradation of the building and grounds and also potential violation <br />of the conditional use permit which prohibits outside sales and <br />rental. Again requested compliance with all codes. <br /> <br />July 18, 2005: Conducted an inspection of the property, observed that no progress <br />had been made; non-conforming signs still present, roof remained in <br />a partial state of demolition, site and grounds overgrown with weeds <br />and tall grass. <br /> <br />August 22, 2005: Conducted a reinspection, still no progress in any regard. <br /> <br />August 29, 2005: Inspected the property, spoke with gas station attendant, asked <br />when the lawn would be cut, as it is in violation of City Code. <br />Attendant indicated grass would be cut the following day. <br />Documented with a Notice of Violation. <br /> <br />September 2, 2005: Issued Mr. Bteibet Ramsey County Court Citation 905113121 <br />documenting three specific violations: <br /> <br />• Section 607.04, Subd. 1, which states that “Buildings, fences and other structures which <br />have been so poorly maintained that their physical condition and appearance detract from <br />the surrounding neighborhood are declared to be Public Nuisances.” <br /> <br />• Section 1008.12, Subd. 3, which prohibits roof mounted signage. <br /> <br />• Section 1114.04, Subd. 3b, which provides for the conditions under which a motor fuel <br />station may operate, specifically, maintaining the building and grounds so as to not <br />become a blighting influence <br />
