<br />Item No: 7J <br />Meeting Date: Jan 23, 2006 <br />Type of Business: CB <br />Administrator Review: ____ <br />City of Mounds View Staff Report <br /> <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Consideration or Resolution 6725,a Resolution <br />Approving an Easement Grant to Medtronic, Inc. <br /> <br />Introduction: <br /> <br />When the City closed on the land sale to Medtronic, there was a limited Use Agreement <br />included in the closing documents as required by the Development Agreement (which had <br />been executed Aug 31, 2005) relating to the right of access over a portion of the “triangle <br />parcel.” The agreement was to allow the fire access road to cross over the City’s land as well <br />as to allow use of the existing trail as a tie-in with the trails on the Medtronic parcel. The <br />pedestrian trail would double as the means of access to Clear Channel Outdoor for <br />maintenance to Sign #6 <br /> <br />Discussion: <br /> <br />The terms of the Development Agreement indicate that after the land sale was executed, the <br />limited use agreement for the fire access road and pedestrian trail would be redrafted into the <br />form of an easement. Kennedy & Graven has drafted the easement which is attached for the <br />Council’s review, along with the original limited use agreement. The attached map highlights <br />the areas covered under the easement document. <br /> <br />Recommendation: <br /> <br />Staff and the City Attorney recommend approval of Resolution 6725, a resolution approving <br />the execution of an easement over the triangle parcel for Medtronic, Inc. <br /> <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />Community Development Director <br /> <br />
