Item No:7F
Meeting Date:02-13-06
Type of Business: CB
Administrator Review: _____
City of Mounds View Staff Report
To: Honorable Mayor and City Council

From: Jeremiah Anderson, Housing/Code Enforcement Inspector

Item Title/Subject: Resolution 6733 Authorizing Abatement of Nuisance
Conditions at 2408-10 County Rd I

Date of Report: February 2, 2006

Background:
On December 28, 2005 a notice of violation was issued and served upon the responsible
parties for violations of the City Code present at 2408-10 County Rd I, AKA Sam’s food
market and a self serve laundry.

Discussion:

The notice of violation dated December 28, 2006 cited a garbage dumpster located
outside of the enclosure and graffiti painted on the exterior of the building in several
locations. A follow up inspection conducted shortly thereafter revealed the dumpster had
been relocated inside the enclosure; however, in regards to the graffiti, corrective actions
had not been completed. To date, the graffiti remains visible on the exterior of the
building and staff has not received communication from the building owner.

Section 607.02 Subdivision 1 of the City Code defines a nuisance a condition that:
“maintains or permits a condition that unreasonable annoys, injures or endangers the
safety, health, comfort or repose of members of the public”. Graffiti is a visual symbol of
disorder eroding public safety, contributing to a downward spiral of blight and decay,
lessening property values, business viability and ultimately tax revenues and, as such, is
inconsistent with the city’s property maintenance goals and aesthetic standards.
Therefore, the failure to maintain one’s property by removing graffiti within a reasonable
period of time is injurious to the public health, safety, and general welfare of the residents
of the city and constitutes a public nuisance under this section.
