<br />Item No:7F <br />Meeting Date:02-13-06 <br />Type of Business: CB <br />Administrator Review: _____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br /> <br />From: Jeremiah Anderson, Housing/Code Enforcement Inspector <br /> <br />Item Title/Subject: Resolution 6733 Authorizing Abatement of Nuisance <br />Conditions at 2408-10 County Rd I <br /> <br />Date of Report: February 2, 2006 <br /> <br /> <br />Background: <br />On December 28, 2005 a notice of violation was issued and served upon the responsible <br />parties for violations of the City Code present at 2408-10 County Rd I, AKA Sam’s food <br />market and a self serve laundry. <br /> <br />Discussion: <br /> <br />The notice of violation dated December 28, 2006 cited a garbage dumpster located <br />outside of the enclosure and graffiti painted on the exterior of the building in several <br />locations. A follow up inspection conducted shortly thereafter revealed the dumpster had <br />been relocated inside the enclosure; however, in regards to the graffiti, corrective actions <br />had not been completed. To date, the graffiti remains visible on the exterior of the <br />building and staff has not received communication from the building owner. <br /> <br />Section 607.02 Subdivision 1 of the City Code defines a nuisance a condition that: <br />“maintains or permits a condition that unreasonable annoys, injures or endangers the <br />safety, health, comfort or repose of members of the public”. Graffiti is a visual symbol of <br />disorder eroding public safety, contributing to a downward spiral of blight and decay, <br />lessening property values, business viability and ultimately tax revenues and, as such, is <br />inconsistent with the city’s property maintenance goals and aesthetic standards. <br />Therefore, the failure to maintain one’s property by removing graffiti within a reasonable <br />period of time is injurious to the public health, safety, and general welfare of the residents <br />of the city and constitutes a public nuisance under this section. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
