Item No. 7E <br />Meeting Date: March 13, 2006 <br />Type of Business: CB <br />WK: Work Session; PH: Public Hearing; <br />CA: Consent Agenda; CB: Council Business <br />City Administrator Review _______ <br /> City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Greg Lee, Director of Public Works <br /> <br />Item Title/Subject: Resolution 6767 Approving the Preliminary <br />Feasibility Report, Waiving Public Improvement <br />Hearing, Ordering the Project, and Authorizing the <br />Preparation of Plans and Specifications for the <br />Medtronic Utility Extension Project <br /> <br /> <br />Background: <br />On October 10, 2005, the City Council approved Resolution 6652 authorizing the <br />preparation of a preliminary feasibility report and consultant selection for the <br />extension of public utilities to the Medtronic CRM Development Project <br /> <br />On March 6, 2006 a draft preliminary feasibility report was submitted to the City <br />Council at a Work Session. <br /> <br /> <br />Discussion: <br />Preliminary Report - On the basis of the City Council's previous action, a <br />preliminary feasibility report has been prepared. Based upon this analysis the <br />project is felt to be necessary, cost effective and feasible. A copy of the feasibility <br />report is attached for the Council's review. <br /> <br />Waive Public Improvement Hearing – The purpose of the public improvement <br />hearing is to provide interested parties an opportunity to learn more about the <br />proposed improvements and to comment on them. Financing for the extension of <br />public utilities to the Medtronic CRM Development Project will be derived entirely <br />from the developer, Medtronic. Since assessments are not a funding source, and <br />the City has been petitioned for these improvements via developer’s agreement <br />with Medtronic, according to State Statute, a Public Improvement Hearing is not <br />required. <br /> <br />For this reason Staff recommends that an official hearing be waived as per state <br />statute. However, waiving the official hearing does not precluded the City from <br />conducting a hearing or allowing public input; it simply releases the City from the <br />requirement of notification and advertisement.
