<br />Sign Code Ordinance Report <br />March 27, 2006 <br />Page 3 <br /> <br />Minimum spacing between billboards is decreased to the state minimum, 500 feet. The <br />height limits are restated at 45 feet, and finally, the subdivisions relating to nonconformity are <br />deleted and replaced with new language as indicated in Section 14. <br /> <br />Section 11: The language regarding garage sale, estate sale and open house signs is <br />deleted due to concerns about first amendment consistency. The effect of the change is that <br />such signage will no longer be expressly allowed. <br /> <br />Section 12: The language regarding temporary signs is clarified to remove the word <br />“advertising.” <br /> <br />Section 13: Relating to prohibited roof signs, language that is better addressed in Section 14 <br />is deleted. <br /> <br />Section 14: The changes proposed in this section are a result of recent legislation and court <br />cases relating to nonconforming signs, as recommended by the City Attorney. A memo from <br />the City Attorney’s office is included for the Council’s reference. <br /> <br /> <br />Recommendation: <br /> <br />Adopting this ordinance will amend Chapter 1008 of the City Code relating to Signs and <br />Billboards to be more consistent with the First Amendment by making the requirements more <br />“content neutral” and by bringing the Sign Code into compliance with the terms and <br />conditions agreed upon by the City and Clear Channel. Staff recommends approval of the <br />second reading and adoption of Ordinance 769.
