ORDINANCE NO. 498 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> An ordinance implementing a franchise fee on electric and natural <br /> gas utility companies for the operation of the utility within the <br /> City of Mounds View. <br /> The City Council of the City of Mounds View does ordain: <br /> SECTION I. PURPOSE <br /> Subd. 1. The Mounds View City Council has determined that it <br /> is in the best interest of the City to impose a franchise fee on <br /> those public utility companies that provide gas and electrical <br /> services within the City of Mounds View. <br /> Subd. 2 . Pursuant to City Ordinance No. 291, Section 12 and <br /> Ordinance No. 292, Section 11 and the Franchise Agreement between <br /> the City of Mounds View (the City) and Northern States Power <br /> Company (the Company) dated May 1, 1989, a franchise fee of not <br /> more than four percent (4%) of the Company's gross operating <br /> revenues may be imposed by the City at any time during the 20 year <br /> term of the Franchise. The franchise fee is paid as full <br /> compensation for the rights to transmit and furnish electric energy <br /> for light, heat, power and import, transport, sell and distribute <br /> gas for heating, illuminating and other purposes as outlined in <br /> Section 2 of Ordinance No's 291 and 292 . <br /> SECTION II . STATEMENT <br /> A franchise fee is hereby imposed on Northern States Power <br /> Company, a Minnesota Corporation, for its electrical and gas <br /> franchise granted by the City, in the amount of 3% of Northern <br /> States Power Company's gross operating revenue. <br /> SECTION III . DEFINITION <br /> The term "gross operating revenues" means all sums, excluding <br /> any surcharge collected by a supplier of natural gas or electric <br /> service from the sale of such services used within the corporate <br /> limits of the City provided, however, there shall be excluded from <br /> the computation of gross revenues all sums received by a supplier <br /> for electric service used for highway lighting, municipal street <br /> lighting, municipal water pumping, municipal sewage disposal <br /> services, municipal sewer lift stations, municipal buildings, <br />
