The <br /> statute has created a situation where large corporate polluters are <br /> shifting large percentages of clean-up costs from them to local <br /> governments . The cost to local governments across the nation is <br /> staggering. <br /> There has been an amendment to the Superfund statute introduced both in <br /> the House and the Senate which would provide substantial financial <br /> relief to local governments . The legislation proposed would: <br /> 1. Amend the Superfund statute to clearly provide that <br /> municipal solid waste is not a hazardous substance <br /> in the same fashion as provided under the Resource <br /> Conservation and Recovery Act. <br /> 2. Empower only the Federal Government to sue local <br /> governments for cost-sharing under the Superfund <br /> statute if local governments may have handled any <br /> truly hazardous waste. <br /> 3. Clearly defining that the degreee of toxicity, not <br /> the volume of waste, should be the prime facer in <br /> assessing any liabilities under the Superfund statute. <br /> It is important that the City's U.S. Senators and Representatives <br /> support the proposed legislation.
