This date coincides with the date of a tornado <br /> which hit both Mounds View and New Brighton and could explain the <br /> possible trips to Oakgrove---if in fact trips were made. The <br /> attorney who found the tickets has not been in his office for the <br /> past two days, so it has not been possible to secure copies of the <br /> tickets. <br /> Both Mr. Karney and I feel that before the City of Mounds View can <br /> make a determination of the benefits or liabilities of joining the <br /> group of PRP's, several factors need to be clarified: <br /> * Is the City of Mounds View actually listed as a Potentially <br /> Responsible Party (PRP) and therefore in jeopardy of <br /> being held responsible for a portion of the clean up costs? <br /> At this time, it is unclear if, in fact, Mounds View is a <br /> PRP. We will have more information by Monday, July 22nd. <br /> If identified as a transporter, the City would fall into <br /> what is called the "Tier 4" group and the share of the <br /> costs would be approximately $24,000. <br /> * If the trip tickets prove to exist and indicate that the <br /> City transported only brush to the Landfill following a <br /> storm, to what degree, if any, does the City wish to <br /> participated in a group of PRPs . Is it better to remain <br /> an independent party and hire outside counsel to litigate <br /> the matter -- anticipating a cost less than the $24,000? <br /> * There has been indications that the large group of PRPs <br /> may seek litigation against any identified PRP which <br /> does not join their group. The more PRPs which join <br /> together, the less each pays for the share of the clean up <br /> costs. Joining the group essentially "buys down" the cost of <br /> the clean up. <br /> The-group-o-f PRPs which-ha-va-banded-tege-ther-i-n-t --tee-hair-e-been <br /> given a deadline of July 22nd in which to decide whether or not to <br /> sign a Consent Decree. Thd- Decree is required by the EPA of all <br /> identified PRPs who which to agree to fund the clean up themselves <br /> and not chance an EPA lawsuit which would be triple the cost of the <br /> actual clean up plus interest and penalties. <br /> New Brighton has agreed to sign the Consent Decree. Arden Hills is <br /> meeting on Monday to discuss the matter, and Fridley is unaware of <br /> their status in terms of identification as a transporter. <br /> It must be noted that the EPA has not made any effort to <br /> communicate fully and completely with anyone in regards to this <br /> matter.' Also New Brighton and other named PRP have been involved <br /> in the Oakgrove Landfill PRP group from the beginning. The initial <br /> cost of joining the group is $1,500 .
