WlU <br /> MEMORANDUM <br /> TO: MAYOR AND CITY COUNCIL <br /> FROM: PAUL HARRINGTON, PLANNING TECHNICIAN 1 . <br /> DATE: June 3, 1991 <br /> SUBJECT: INCLUSION OF DELINEATED WETLANDS IN CHAPTER 52 OF THE <br /> MUNICIPAL CODE <br /> Pursuant to Council request, staff has reviewed Chapter 52 of the <br /> Municipal Code for the potential inclusion of delineated wetlands <br /> within the defined protected areas. <br /> Chapter 52 .02 (1) "Definitions" , reads as follows: <br /> "Parks, playground, open space, and recreation area. Any <br /> area, designed by the City of Mounds View, wherever located <br /> within the City which is reserved, designated or used for <br /> active or passive recreation and which is owned, operated or <br /> controlled by the City or controlled by another government <br /> unit. " <br /> Chapter 52 .04 of the Municipal Code prohibits the use of <br /> motorized vehicles within these defined areas unless engaged in <br /> official City business or otherwise specifically authorized by <br /> the Clerk-Administrator. <br /> Council has expressed concern that wetlands within the City do <br /> not fall within the parameters of the aforementioned definition <br /> and therefore, no regulation of motor vehicle operation within <br /> the wetlands can be enforced. <br /> Staff recommends that the definition in 52 .02 (1) be amended to <br /> read as follows: <br /> "Parks, playground, open space, and recreation area. Any <br /> area, designed by the City of Mounds View, wherever located <br /> within the City which is reserved, designated or used for <br /> active or passive recreation and which is owned, operated or <br /> controlled by the City or controlled by another government <br /> unit. Included in this definition, for the purposes of this <br /> Chapter, are all delineated wetlands located within the <br /> City. " <br /> If Council determines that the amendment is satisfactory, staff <br /> can begin procedures necessary to adopt the amendment. <br />
