Z`F <br /> iREQUEST FOR COUNCIL CONSIDERATION Agenda Section: Item 8 <br /> 1111706 , TAFF REPORT Report Number: 91-14A <br /> AGENDA SESSION DATE May 6, 19 91 Report Date: May 6 , 199 <br /> DISPOSITION <br /> Item Description: Minor Subdivision Request by the Estate of Arlien Newton, <br /> 8300 Fairchilvenue, Planning Case No. 322-91 <br /> Administrator's Review/Recommendation: <br /> - No comments to supplement this report <br /> - Comments attached. <br /> Explanation/Summary (attach supplement sheets as necessary.) <br /> SUMMARY; <br /> Sandi Pidel, representing the estate of Arlien Newton, has requested a minor subdivision for the property located <br /> at 8300 Fairchild Avenue, legally known as Auditor's Subdivision No. 89, Lot 5, Block 1, Gustafson's 1st Addition <br /> and in said Auditor's Subdivision No. 89 the North 95.07 feet(subject to roads and easements) of Lot 68, and <br /> shown on the attached certificate of survey dated March 25, 1991. <br /> Staff has reviewed this subdivision request and found it to be, in concept, in conformance with Chapter 42 of the <br /> Municipal Code which governs subdivisions. However, conditions do exist on the site which need to be addressed. <br /> City Engineer Minetor has reviewed the proposal and his suggestions are included in a memo to myself dated <br /> April 17, 1991. A copy of this memo is attached for your review. Specifically, the issues of road right-of-way and <br /> the non-conforming structure need to be remedied. <br /> Chapter 42.09 Subd. 2 (1)c of the Mounds View Municipal Code specifies the minimum street right-of-way widths <br /> within the City. For a local street(which both Groveland and Fairchild are), the minimum dimension is 60 feet. <br /> This standard dimension would require that the City attain those portions of the subdivided property needed to <br /> meet these minimums. <br /> Secondly, the location of the garage requires that either a written agreement or land acquisition take place to <br /> provide for a resolution to the matter. Staff is in the process of polling the members of the Park Commission for <br /> their suggestions. The responses of the Commissioners will be available Monday evening. <br /> At the-Regularly-scheduled-Pla ' ' sion-Meeting-of-May-1,-1991, Pl 'ssion_Resolution Nn <br /> 312-91 recommending approval of the subdivision was adopted. However, a contingency attached to the adoption <br /> of this resolution was that only 15 feet of right-of-way along Fairchild Avenue and no right-of-way along <br /> Groveland Road be acquired. This contingency is not in conformance with the previously referred to section of <br /> Chapter 42 governing road right-of-way widths. Staff recommends that this item be re-examined by Council.
