<br />Sign Code Ordinance Report <br />April 24, 2006 <br />Page 2 <br /> <br />Subsequent to the April 3rd meeting, representatives from Clear Channel communicated <br />concerns to staff regarding the elimination of the County Road 10 locations as well as three <br />other provisions of the ordinance relating to the duration of the IUP for the relocated signs, <br />the definition of “expansion” and wording relating to non-conforming uses. The City Attorney <br />reviewed the concerns raised by Clear Channel and find that the ordinance should be <br />revised relating to the duration of the IUP for the relocated signs, as the language in the <br />earlier version of the ordinance was not completely consistent with the agreement between <br />the City and Clear Channel. As to the other concerns, the Attorney finds that the ordinance <br />should stand as written. <br /> <br />The proposed revision to Section 1008.10, Subd 6 relating to the duration of the IUP is as <br />follows: <br /> <br />a. Interim Use Permit: An interim use permit (IUP) must be obtained in accordance <br />with procedures identical in form and substance to the conditional use permit <br />procedures found in Section 1125.01, subdivision 3 of the Mounds View Municipal <br />Code. Any IUP issued for an interim use billboard shall automatically expire on July <br />1, 2037, or earlier if so indicated in the resolution approving the IUP. An IUP shall <br />be null-and-void if the applicant fails to obtain any required permit from the State of <br />Minnesota. <br /> <br /> <br />Finally, the issue of whether or not to allow billboards on County Road 10 will likely need to <br />be re-addressed, as representatives from Clear Channel, Medtronic and individual property <br />owners may request such action. <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />Community Development Director <br /> <br /> <br />Attachments: <br />1.
