Item No. 07C <br />Type of Business: PH & CB <br />Meeting Date: June 12, 2006 <br />City Administrator Review: ______ City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Desaree Crane, Assistant to the City Administrator <br />Item Title/Subject: Public Hearing to Consider Resolution 6830, a <br />Resolution Approving An Intoxicating Liquor Business <br />License (Off-Sale) for ABC Liquor located at 2840 <br />Highway 10 <br /> <br />In accordance with Ordinance 771, which became effective June 4, 2006, revised Section 502.08 of the <br />City Code. With the passing of Ordinance 771 on April 24, 2006, Section 502.08 now states: <br /> <br />502.08: LICENSE HEARING: <br /> <br />No issuance of a new license, transfer of an existing license, renewal of an existing license, issuance <br />of temporary special event or banquet licenses, or special outdoor consumption endorsements for <br />the sale of intoxicating liquor on-sale or off-sale, club, Sunday sales or on-sale wine shall be <br />hereafter granted by the Council until a public hearing has been conducted by the Council after <br />published notice in the official newspaper at least ten (10) days in advance of the hearing. <br /> <br /> <br />The City of Mounds View issued an intoxicating liquor license for ABC Liquor in June of 2005, and their <br />renewal is before the Council for consideration. ABC Liquor’s Intoxicating Liquor License will expire June <br />30, 2006. The notice of this public hearing was sent out to residences within a 350 feet radius, and the <br />Notice of Public Hearing was published in the Mounds View/New Brighton Bulletin. <br /> <br />ABC Liquor has submitted their city liquor license application materials and the applicable fees. The <br />following investigations and inspections have been conducted to determine whether there is cause for the <br />City to deny any of the above referenced intoxicating liquor license application: <br /> <br />Police Inquiry and Investigations (Mounds View Police Department) <br />Attached is a Police Report along with a memorandum from Bob Vose an attorney from Kennedy and <br />Graven. There is an area of concern with this police report in regard to selling alcohol to minors. This is <br />the establishment’s first violation on record. <br /> <br />Utility Billing Inquiry (City of Mounds View) <br />The Finance Department has issued a satisfactory report for ABC Liquor. <br /> <br />Fire Inspection (City of Mounds View Fire Marshal) <br />The City’s Fire Marshal has inspected ABC Liquor and issued a satisfactory report. <br /> <br />Recommendation <br />Staff recommends that the City Council open the Public Hearing for public input. Due to the concerns <br />stated in the police report, staff would like to discuss how to proceed with this business license renewal. <br />Since this is a first violation with the owner, and the owner is not currently convicted, we could proceed <br />with the renewal and monitor the proceedings of the case. A Resolution approving this license is <br />attached if the Council wishes to approve the liquor license. If the City Council wishes to investigate this <br />matter further, then the City Council could also open the Public Hearing for public comment and postpone <br />this renewal until the next City Council Meeting. If this renewal is approved, the time period of this license <br />will be July 1, 2006 to June 30, 2007. <br /> <br />Respectfully Submitted, <br />Desaree Crane <br />
