Item No. 07D <br />Type of Business: PH & CB <br />Meeting Date: June 26, 2006 <br />City Administrator Review: ______ City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Desaree Crane, Assistant to the City Administrator <br />Item Title/Subject: Continued Public Hearing to Consider Resolution 6830, <br />a Resolution Approving An Intoxicating Liquor Business <br />License (Off-Sale) for ABC Liquor located at 2840 <br />Highway 10 <br /> <br /> <br />At the June 12, 2006, City Council Meeting, a Public Hearing to consider Resolution <br />6830, a Resolution approving an Off-Sale Intoxicating Liquor License for ABC Liquor <br />was opened and closed for public comment. Mr. Xiong, the owner of ABC Liquor was <br />the only person that spoke to the City Council in regard to this renewal. <br /> <br />At the June 12, 2006, City Council Meeting, the City Council was made aware of a <br />Police Report, which indicated a violation with regard to selling alcohol to minors. This <br />is the establishment’s first violation on record. Mr. Xiong spoke to the City Council at <br />the June 12th meeting about the events on the Police Report. It was the City Council’s <br />recommendation to table this Off-Sale Intoxicating License renewal until the City <br />Attorney was available to able answer questions from the City Council. Attached is the <br />Police Report, along with the Memorandum from Bob Vose of Kennedy and Graven for <br />your information. The Mounds View City Attorney will be present at this Council <br />Meeting to answer any questions you may have. <br /> <br /> <br />Recommendation <br />Staff recommends that the City Council ask the necessary questions about this police <br />report to the City Attorney. Mr. Xiong, the owner of ABC Liquor will be present at this <br />City Council meeting to answer any additional questions. Since this is a first violation <br />with the owner, and the owner is not currently convicted, we could proceed with the <br />renewal and monitor the proceedings of the case. A Resolution approving this license <br />is attached if the Council wishes to approve the liquor license.
