First Reading and Introduction of Ordinance 773 Amending the Zoning 6 <br />Code Relating to Landscaping, Fences and Retaining Walls 7 <br /> 8 <br />Director Ericson stated this is a first reading of an ordinance that would amend the zoning code 9 <br />relating to definitions, which do not currently exist, and adding language under 1103 regarding 10 <br />fences and adding language relating to retaining walls and prohibited materials. 11 <br /> 12 <br />Director Ericson explained that the Council asked the Planning Commission to consider adding 13 <br />language and the Commission suggested adding language and making changes regarding 14 <br />setbacks. He said the Commission did adopt a resolution, which defined retaining walls and 15 <br />added definitions regarding landscaping and addressed issues regarding the setback issue. 16 <br /> 17 <br />Director Ericson summarized the changes would add definitions to landscaping and retaining 18 <br />walls as follows: 19 <br />LANDSCAPING: The aesthetic and physical improvement of land by the addition of berms, 20 <br />trees, shrubs, ground cover, crushed rock, wood chips, retaining walls and other functional, 21 <br />ornamental, or decorative features. 22 <br /> 23 <br />RETAINING WALL: A wall or structure constructed of stone, concrete, woo, or other 24 <br />materials, used to retain soil or as slope transition, or edge of a planting area. 25 <br /> 26 <br />Director Ericson stated that under 1103.08, in the area discussing fencing, there was an addition 27 <br />which now reads: 28 <br />A fence or retaining wall shall be installed on the applicant’s property. The fence or 29 <br />retaining wall shall not be installed directly over the property line. 30 <br /> 31 <br />Director Ericson noted that at the bottom of page 2 of the report, there said on the bottom of page 32 <br />2, under Subdivision 7, there was an addition of prohibited materials, which now reads: 33 <br />a. Barbed Wire, razor wire, or other materials which could cause bodily harm shall be 34 <br />prohibited and no fence or property shall be wired and designed to conduct and 35 <br />emit an electrical charge, except as allowed for below. 36 <br />b. Exceptions: Facilities providing essential services or municipal governmental services 37 <br />may erect barbed wire or other materials having a similar deterrence, upon notice 38 <br />to properties within 350 feet and upon approval of the City Council. 39 <br /> 40 <br />He explained that essential services such as a water supply or something similar that needs 41 <br />protection would require notification. He said that it allows for barbed wire or the like to be used 42 <br />for a homeland security issue. 43 <br /> 44 <br />Director Ericson said that a Public Hearing would occur during the next meeting on June 26. 45
