<br /> <br /> <br /> <br />RESOLUTION NO. 6875 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION DENYING AN INTERIM USE PERMIT (IUP) REQUEST FOR A <br />BILLBOARD AT 2200 COUNTY ROAD 10, PLANNING CASE IU2006-001 <br /> <br />WHEREAS, Clear Channel Outdoor has requested approval of an Interim Use <br />Permit to locate a billboard at 2200 County Road 10, the site of the Mermaid <br />Entertainment Center and AmericInn Hotel; and, <br /> <br />WHEREAS, the Mermaid site is zoned Planned Unit Development (PUD) and is <br />legally described as follows: <br /> <br />MERMAID HOTEL AND ENTERTAINMENT CENTER <br />COMMON INTEREST COMMUNITY PLAT <br />RAMSEY COUNTY, MINNESOTA <br /> <br />WHEREAS, The City of Mounds View has adopted Ordinance 769 which <br />amended the City Code to permit billboards as an interim use on properties adjacent to <br />the south side of County Road 10 south of its intersection with Woodale Drive; and, <br /> <br />WHEREAS, the Applicant has submitted a survey depicting the location and setback <br />of the proposed billboard; and <br /> <br />WHEREAS, the Mounds View City Council held a duly-noticed public hearing on <br />July10, 2006; and, <br /> <br />WHEREAS, the Mounds View City Code requires that any billboard Interim Use <br />Permit (IUP) application be reviewed and considered in accordance with Section 1125.01, <br />Subdivision 3; and, <br /> <br />WHEREAS, the Mounds View Planning Commission has recommended denial of <br />the requested IUP based on obstruction issues. <br /> <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council makes <br />the following findings of fact relating to the Clear Channel Outdoor application for an <br />Interim Use Permit (IUP) for a billboard at 2200 County Road 10: <br /> <br />1. The billboard at the proposed location would detrimentally affect the adjoining <br />property due to obstruction from the column and sign faces. <br /> <br />2. The billboard could potentially be located elsewhere on County Road 10 causing <br />less impact and obstruction to the subject and adjacent properties. <br />
