<br /> <br /> <br />Item No: 7C <br />Meeting Date: July 10, 2006 <br />Type of Business: PH & CB <br />Administrator Review : ______ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Second Reading and Adoption of Ordinance 775, an <br />Ordinance Vacating a Highway Easement Associated with <br />the Hidden Hollow South Major Subdivision <br /> <br />Introduction: <br /> <br />The City Council approved the Hidden Hollow South final plat on April 24, 2006. The residential <br />subdivision created six single family home sites from two deep lots on Woodale Drive. The model <br />home located at 3041Woodale Drive is already under construction. When the plat was delivered <br />to Ramsey County for recording, the County Surveyor rejected it due to the presence of a <br />“Highway Easement” at the rear of the lots. The County’s policy, as we have learned, is that right <br />of way easements may not persist as easements—they shall either be dedicated as right of way or <br />vacated. Until one of the two actions is undertaken, the plat cannot be recorded. <br /> <br /> <br />Discussion: <br /> <br />The easement was granted in 1966 to the City for highway and utility purposes. The City has no <br />desire to develop this easement as right of way thus prompting the need to vacate the highway <br />easement. The applicant will rededicate a drainage and utility easement in the same area <br />however neither did the City have any opposition to the 30-foot easement remaining for utility <br />purposes. When all is said and done, the net effect of this will have been to strike the word <br />“Highway” from the easement at substantial cost to the property owner both from a monetary and <br />timing perspective. <br /> <br />The City Council approved the introduction and first reading of this ordinance at the June 26 <br />meeting and established the public hearing for the meeting on July 10, 2006. No public comment <br />has been received regarding this action. <br /> <br /> <br />Recommendation: <br /> <br />Staff recommends the City Council hold the public hearing and approve the second reading and <br />adoption of the attached Ordinance 775 which authorizes the vacation of an old highway <br />easement which no longer serves a public interest. A roll call vote is required for this action. <br /> <br /> <br />James Ericson <br />Community Development Director
