<br /> <br /> <br />Clear Channel IUP Report <br />July 10, 2006 <br />Page 4 <br /> <br />(8) Adequate utilities, access roads, drainage and necessary facilities have been or will be <br />provided. <br /> <br />Access to the billboards will be gained via Woodale Drive and Program Avenue.. <br /> <br />Based on the review of the adverse effects criteria and the general CUP requirements, <br />criteria, it appears to staff the proposed billboard satisfies all relevant code requirements <br />and regulations pertaining to billboards in the community, consistent with Ordinance 769 and <br />the Relocation agreement. <br /> <br /> <br />Public Notice: <br /> <br />Staff sent notices to property owners within 350 feet of the Building A property and published <br />a copy of the notice in the June 28, 2006 edition of the Bulletin. No residents or property <br />owners have contacted staff regarding the request. <br /> <br /> <br />Summary: <br /> <br />The requested Interim Use Permit appears to satisfy all Code requirements and would not <br />appear to cause any appreciable adverse impacts to the area in which the billboard would be <br />located. The Planning Commission has recommended approval of the IUP request, their <br />resolution is attached for the Council’s reference. <br /> <br /> <br />Recommendation: <br /> <br />Hold the public hearing and discuss the request for the IUP. Based on staff’s review and the <br />Planning Commission’s recommendation of approval, Resolution 6876 approving the Interim <br />Use Permit request has been prepared and is available for the Council’s action. If approved, <br />Clear Channel would then request a permit from the Minnesota department of Transportation <br />(MnDOT.) If additional information is necessary before action can occur, a motion to table or <br />postpone would be in order. If the City Council does not believe a billboard at this location <br />satisfies the intent of the Code requirements, staff would need to be directed to draft a <br />resolution of denial for action at the next Council meeting occurring on July 24, 2006 <br /> <br /> <br /> <br />_____________________________________ <br />James Ericson <br />Community Development Director <br /> <br /> <br /> <br /> <br /> <br />
