To postpone approval of Resolution 6853 8 <br />Authorizing the Contract for Architectural Services for the Preparation of Plans and 9 <br />Specifications for the Mounds View Community Center and discuss it further at the July 17th 10 <br />work session. 11 <br /> 12 <br />Mayor Marty stated that until this meeting, he was ready to approve the expenditures. First Reading and Introduction of Ordinance 775, an Ordinance Vacating an 18 <br />Excess Highway Easement Associated with the Hidden Hollow South 19 <br />Residential Subdivision 20 <br /> 21 <br />Community Development Director Ericson explained that this request would vacate an easement 22 <br />that was dedicated to the City in 1976. He stated the City had no problem with the easement, but 23 <br />Ramsey County rejected the plat because of it. 24 <br /> 25 <br />Community Development Director Ericson explained the City Council approved the Hidden 26 <br />Hollow South final plat on April 24, 2006. He stated the residential subdivision created six 27 <br />single-family home sites from two deep lots on Wooddale Drive. He said that when the plat was 28 <br />brought to Ramsey County for recording, the County Surveyor rejected it due to the presence of a 29 <br />“Highway Easement” at the rear of the lots. He stated the County’s policy, as he has learned, is 30 <br />that right of way easements may not persist as easements – they shall either be dedicated as right 31 <br />of way or vacated. He said until one of the two actions is undertaken, the plat cannot be 32 <br />recorded. The effect is to strike the word “highway” from the plat. He said the second reading 33 <br />and public hearing would be at the next City Council meeting. 34 <br /> 35 <br />Mayor Marty asked if it would vacate the highway and keep the easements and Director Ericson 36 <br />replied it would. 37 <br /> 38 <br />MOTION/SECOND: THOMAS/STIGNEY. To waive the reading and adopt Ordinance 775, an 39 <br />Ordinance Vacating an Excess Highway Easement associated with the Hidden Hollow South 40 <br />Residential Subdivision. 41 <br /> 42 <br /> Ayes – 5 Nays – 0 Motion carried. 43 <br /> 44
