<br /> <br /> <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 844-06 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION DENYING A VARIANCE REQUEST FOR A 45-FOOT TALL <br />BILLBOARD AT 2200 COUNTY ROAD 10, PLANNING CASE VR2006-004 <br /> <br /> <br />WHEREAS, Clear Channel Outdoor has requested approval of a variance to exceed <br />the maximum sign height by ten feet for a billboard to be located at 2200 County Road 10, <br />the site of the Mermaid Entertainment Center and AmericInn Hotel; and, <br /> <br />WHEREAS, the Mermaid site is zoned Planned Unit Development (PUD) and is <br />legally described as follows: <br /> <br />WHEREAS, The City of Mounds View has adopted Ordinance 769 which amended <br />the City Code to permit billboards as an interim use on properties adjacent to the south <br />side of County Road 10 south of its intersection with Woodale Drive; and, <br /> <br />WHEREAS, the Mounds View Planning Commission held a duly-noticed public <br />hearing on June 21, 2006; and, <br /> <br />WHEREAS, the Chapter 1125 of the Zoning Code establishes the review criteria <br />against which all variance applications shall be judged and satisfied for a variance to be <br />granted. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning <br />Commission makes the following findings of fact relating to the Clear Channel Outdoor <br />application for a variance to exceed by ten feet the maximum established height provision <br />for a billboard on County Road 10: <br /> <br />1. Exceptional or extraordinary circumstances do not apply to this property which <br />would warrant approval of the requested variance. There are other potential <br />locations within the County Road 10 corridor at which a billboard could potentially be <br />sited without obstruction from or obstruction to existing buildings or signs. <br /> <br />2. The literal interpretation of the provisions of this Title would not deprive the <br />Applicant the ability to site a billboard within the County Road 10 corridor. <br /> <br />3. Granting the variance would confer upon the Applicant a special privilege that <br />would not be extended to other property owners on the County Road 10 corridor. <br /> <br />4. The variance would be materially detrimental to the purpose of this Title or to other <br />property in the corridor in that the City desires lower height signs within the County <br />Road 10 corridor. <br /> <br />
