<br /> <br />Resolution 6875 <br />Option A <br />Page 2 <br /> <br />2. Ordinance 769 identified the subject parcel where a billboard could be located. <br /> <br />3. The proposed billboard would not cause any adverse impacts to the subject <br />property or any adjacent properties. <br /> <br />4. The proposed billboard would not be visible from or cause adverse impacts to <br />residential properties in the area. <br /> <br />5. The proposed billboard would not cause a burden to City services and would not <br />cause congestion or result in additional generated traffic. <br /> <br />6. The proposed billboard is not inconsistent with the City’s Comprehensive Plan. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council makes <br />the following findings of fact relating to the Clear Channel Outdoor application for a <br />Variance for a 45-foot tall billboard at 2200 County Road 10: <br /> <br />1. Exceptional or extraordinary circumstances apply to the property which result <br />from circumstances over which the Applicant has had no control, in that the <br />maximum height was recently established by the Mounds View City Council <br />without the benefit of a sight-line analysis or computer generated billboard <br />rendering. The additional ten feet from 35 feet to 45 feet will provide the <br />necessary clearance above existing signs and buildings. <br /> <br />2. The literal interpretation of the provisions of this Title would deprive the Applicant <br />of unobstructed visibility to its proposed billboard and would obscure to some <br />extent existing ground and building signs. <br /> <br />3. The special conditions or circumstances do not result from the actions of the <br />Applicant which is attempting to relocate a billboard consistent with the terms of <br />the approved relocation agreement. <br /> <br />4. Granting the variance would not confer on the Applicant any special privilege <br />that is denied by this Title to owners of other lands, structures or buildings in the <br />same district, in that the Applicant is uniquely affected by Ordinance 769 and the <br />Relocation Agreement. <br /> <br />5. The variance requested is the minimum variance which would alleviate the <br />hardship which has been graphically illustrated by the Applicant. <br /> <br />6. The variance would not be materially detrimental to the purpose of this Title or to <br />other property in the same zone. <br /> <br />7. The proposed variance will not impair an adequate supply of light and air to <br />adjacent property or substantially increase the congestion of the public streets or <br />increase the danger of fire or endanger the public safety or substantially diminish <br />or impair property values within the neighborhood. <br />
