Item No. 07J <br />Type of Business: CB <br />Meeting Date: August 14, 2006 <br />City Administrator Review: _____ <br /> <br /> <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Desaree Crane, Assistant to the City Administrator <br />Item Title/Subject: Resolution 6903 Authorizing Severance Payment for Thomas <br />Baumgart, Mounds View Police Officer <br /> <br />Background <br /> <br />Thomas Baumgart was terminated from his position due to his inability to perform the essential <br />functions of a police officer as concluded by Mr. Baumgart’s health care provider. This <br />termination was effective July 10, 2006. Attached is Resolution 6903, which authorizes a <br />severance payment to Mr. Baumgart for his accrued compensatory and vacation time. This <br />payment is in accordance with the Mounds View Personnel Manual and the current LELS Police <br />Officers Labor Agreement. <br /> <br />Resolution 6903 provides a payout of Mr. Baumgart’s vacation hours. In accordance with the <br />current LELS Labor Agreement, Mr. Baumgart is eligible for a vacation payout of $5,458.20. <br />This is calculated as 181.94 hours times his hourly salary of $30.00. <br /> <br />Resolution 6903 also provides a payout of Mr. Baumgart’s compensatory time. In accordance <br />with the current LELS Labor Agreement, Mr. Baumgart is eligible for a compensatory time payout <br />of $337.50. This is calculated as 11.25 hours times his hourly rate of $30.00. <br /> <br />It has also come to Staff’s attention that the City is responsible for the continued contribution <br />payment of Mr. Baumgart’s health insurance. In accordance with Minnesota State Statute <br />299A.465, subd 1: <br /> <br />299A.465 Continued health insurance coverage. <br /> <br />Subdivision 1. Officer or firefighter disabled in line of duty. <br /> <br />(a) This subdivision applies when a peace officer or firefighter <br />suffers a disabling injury that: <br /> <br />(1) results in the officer's or firefighter's retirement or <br />separation from service; <br /> <br />(2) occurs while the officer or firefighter is acting in <br /> the course and scope of duties as a peace officer or <br /> firefighter; and <br /> <br /> (3) the officer or firefighter has been approved to receive <br /> the officer's or firefighter's duty-related disability pension.
