Mounds View City Council August 14, 2006 <br />Regular Meeting Page 17 <br /> <br />would like to see continued use by the City, not by a for-profit entity. He added he wants to give 1 <br />the Community Center back to the citizens. He pointed out that two residents spoke in favor of 2 <br />Oops, one of whom is an employee, and that all other residents spoke against the Theater. 3 <br /> 4 <br />Economic Development Coordinator Backman replied that Oops would take care of their own 5 <br />set-up and teardown. He stated that he has told Oops that they would have to pay for their 6 <br />telephone line. He stated that there could be an alternate wording for the word “unencumbered.” 7 <br /> 8 <br />City Attorney Riggs stated there are a number of conditions in the lease that are not consistent 9 <br />and there are several issues the Council should discuss. He stated that the Council needs to 10 <br />determine who has priority in the Center. He pointed out that the document in front of the 11 <br />Council should not be the final version. 12 <br /> 13 <br />Mayor Marty asked about the language stating, “direct supervision and control of a staff 14 <br />member” during set-up and takedown. Ms. Fangel stated that some of the language is still being 15 <br />discussed and that she does not expect the contract in front of the City now to be the final 16 <br />version. She stated that she wants to make sure that phone and Internet is available to the 17 <br />Theater, but they will pay for their own services. 18 <br /> 19 <br />Mayor Marty stated he did not think the direct supervision of the set-up and teardown is 20 <br />necessarily bad to ensure the integrity of the building. Ms. Fangel stated Oops is not opposed to 21 <br />such language. 22 <br /> 23 <br />MOTION/SECOND: MARTY/FLAHERTY. To deny Resolution 6892, Approval of Interim 24 <br />Lease Agreement in the Mounds View Community Center for Oops Dinner Theatre. 25 <br /> 26 <br />Councilmember Gunn stated there is a discrepancy with the Resolution number. City 27 <br />Administrator Ulrich confirmed that it is Resolution number 6892. 28 <br /> 29 <br />Councilmember Stigney stated that because it is an interim lease, it needs more refinement and 30 <br />should not be denied at this point 31 <br /> 32 <br />Mayor Marty stated the goal of the Community Center is to increase programming and start 33 <br />marketing the Community Center to the public. 34 <br /> 35 <br />Councilmember Stigney stated that the Community Center should be self-sufficient, which is one 36 <br />of the goals established by the Council. He stated the Council should consider what other things 37 <br />are happening with the Community Center while the City is determining better uses during the 38 <br />seven-month time period. He stated denying the Theater lease is the wrong thing to do. 39 <br /> 40 <br />Councilmember Flaherty stated he understands that Oops is looking for a place to hold their 41 <br />shows, but he believes that the Center needs to be given back to the citizens. He stated he has 42 <br />examined the calendar and there are many dates being requested by the Theater. He stated he 43 <br />would like a solution determined by Oops and the YMCA working together. He stated he would 44 <br />rather provide the programming for the citizens, but would like Oops and the programming to 45
