<br />Wetland Maps report <br />November 13, 2006 <br />Page 2 <br /> <br />The significance of this definition is such that any wetland area less than or equal to an acre <br />would not need to be noted on the official maps of the City or if noted, would not be buffered. <br />This likely explains why some of the smaller wetland areas were omitted from the original <br />maps series. One can only assume that the Council at that time felt it would be excessive to <br />require 100 feet of buffer on smaller wetlands. If the maps are prepared according to the <br />Code, at least three notable wetlands would not require a buffer, including the Hidden Hollow <br />wetland, the Bronson-Erickson-Quincy wetland and the Groveland Road wetland that was <br />discussed at the October 23 public hearing. It should be noted that Rice Creek Watershed <br />District would retain jurisdiction over the wetlands whether or not they are buffered. <br /> <br />Public Notice <br /> <br />Public hearings were held on October 9 and October 23, 2006. Notices were sent to virtually <br />every affected residential property owner in the City regarding the new maps, regardless of <br />whether or not the wetlands or buffer areas on the property changed. The intent of the <br />notice was to provide residents with a reminder about the City’s wetland regulations and <br />buffer requirements, valuable information especially for newer residents of the community <br />who may otherwise have been unaware of the requirements. <br /> <br />Not a Delineation <br /> It should again be emphasized that the City’s Wetland Zoning maps do not take the place of <br />a wetland delineation. If a property owner is proposing work that may alter or impact a <br />wetland, a delineation will be required before the work may proceed. In the case of higher <br />density residential, new subdivisions, commercial and industrial development, a delineation <br />will be required if wetlands are present on the property, regardless of whether alteration is <br />anticipated. <br /> <br />Recommendations: <br /> <br />Ordinance 780 has been prepared for Council action. Staff is recommending the City <br />Council approve the second reading and adopt Ordinance 780 which approves the updated <br />and revised wetland zoning maps prepared by Short Elliot Hendrickson and dated November <br />8, 2006. Consistent with City Charter, staff further recommends the Council authorize the <br />publication of the ordinance summary in the official City newspaper rather than the full <br />ordinance, with a full text copy of the ordinance saved to the website. <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />Community Development Director <br /> <br />Attachments: <br />1.
