Nothing in this Agreement shall prevent, limit, or <br /> otherwise interfere with the right of the Employee to resign at <br /> any time from his position with the City, subject only to the <br /> provisions set forth in Section 3 , paragraph D, of this <br /> agreement. <br /> SECTION 3 . TERMINATION AND. SEVERANCE PAY <br /> A. In the event the City Council desires to terminate the <br /> services of Employee as Acting Clerk-Administrator, then in that . <br /> event Employee will reinstated in his former position as City <br /> Engineer/Director of Public Works. Upon reinstatement in his <br /> former position, Employee will receive salary and benefits <br /> comparable to those he was receiving at the time of his <br /> appointment as Acting Clerk-Administrator plus any increases <br /> awarded to other City employees as across the board salary or <br /> fringe benefit adjustments. <br /> B. Employee will retain all seniority and benefits accrued <br /> during the period he serves as Acting Clerk-Administrator. <br /> • C. In the event In the event the City reduces the salary or <br /> benefits of Employee in a greater percentage than an applicable <br /> across the board reduction for all City employees, or in the <br /> event Employee resigns following a suggestion, whether formal or <br /> informal, by the City Council that he resign, then in that event <br /> Employee may at his option, be deemed terminated as Acting Clerk- <br /> Administrator at shall be entitled to the benefits set forth <br /> herein. <br /> D. SALARY <br /> City agrees to pay Employee for his services rendered <br /> pursuant hereto an annual base salary of $58,656, payable in <br /> installments at the same time as other employees of the City are <br /> paid. <br /> In addition, City may pay Employee a merit bonus based on <br /> Employee's performance if the City Council deems appropriate. <br /> SECTION 5. AUTOMOBILE <br /> • The City agrees to pay Employee $150 per month for travel <br /> and expenses in performing his duties in the immediate area of <br /> the City and Employee agrees to utilize his personal vehicle for <br />
