3 ' (2/ <br /> MEMORANDUM <br /> Memo To :Mayor and Council Members <br /> From :Ric Minetor, Acting Clerk-Administrator <br /> Date :December 20, 1990 <br /> Subject :Wetland Ordinance Revisions <br /> Ordinance #488 <br /> At, the first reading and hearing of ordinance #488 there was <br /> concern that lawn mowing or other maintenance of existing <br /> landscaping within the wetland buffer zone is not clearly allowed <br /> in the revised ordinance. It is my feeling that this could be <br /> clarified by adding a paragraph C to section 48.07 'EXCEPTIONS: ' <br /> which would read as follows: <br /> C. Maintenance of existing landscaping, including but not <br /> limited to, lawn care; trimming of bushes or trees; tilling, <br /> planting, and/or weeding of gardens; painting or repair of <br /> fences; or similar activities shall be permitted within a <br /> wetland zoning district. This exception is for maintenance <br /> of an existing situation and shall not be construed as to <br /> allow establishment of a new use or expansion of an existing <br /> use in a wetland. This also shall not be construed as to <br /> allow destruction of hydrophytic vegetation. <br /> I have discussed this wording with Peter Sabee of Barr <br /> Engineering. If this amendment is considered appropriate by the <br /> Council, I do not believe any further definition or modification <br /> would be needed to allow the type of routine maintenance <br /> discussed during the hearing and first reading of the ordinance. <br />
